I'd like to know more about the "throw away the constitution" line (at around 1:25-1:30 or so). Where in the US constitution does it say that the government can't deal with "health care, climate change, pollution"?

Sounds like Judicial Activism to me.
I've also heard that that particular judge and the lawyer bringing the case to the judge in the first place have ties to a Republican consulting firm that has campaigned against Obama's Health Care Reform.

Just in case you're wondering... and/or just for the record:
I would also object to a judge appointed by pro-healthcarereformdemocrat type people with a financial interest in democraticpartyhealthcarereformstuff making the same sort of decision.
The problem here is not whether or not the decision maker IS biased. The problem is THE CONFLICT OF INTEREST. They have conflicting interests. It looks as if they might have motivations that they will not admit. Even if only to themselves.
I want to believe such people. But the only way we CAN believe them is if they recognize the conflict of interest and RECUSE themselves. That doesn't mean they are biased. A recusal wold actually suggest that they are unbiased. They would be recognizing that the true motivations of any decision are hard (or impossible) to know; "hidden in the darkness of each man's lonely heart."
